General terms and conditions
of Geysir Andernach gemeinnützige GmbH from 15.06.2020 - Individual guests and families
§ 1 Scope of application / subject matter of the contract
These GTC apply to all facilities of Geysir.info gGmbH and refer to bookable offers in our online ticket shop in the version valid at the time of booking as well as the visit to the facilities.
§ 2 Conclusion of contract
The products shown in our online shop (tickets print@home) are only to be understood as an invitation to order. They do not constitute a binding offer. You make a binding offer to conclude a purchase contract for the selected ticket when you have gone through the online ordering process by entering the information requested there and clicking "Buy now". By clicking the "Buy now" button, you place a binding order for the products contained in the shopping basket. You can correct any mistakes or errors by removing the item from the shopping basket and/or pressing the "Back" button on your browser. The purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail immediately after receiving your order. In the event of non-availability of the ordered goods, we reserve the right not to deliver. In this case, we will inform you immediately and refund any consideration already received without delay.
§ 3 Price and payment
The admission price includes the respective legally reduced VAT rate. As a rule, payment by credit card or Paypal is offered. The deposited account will be debited upon acceptance of the order. The organiser has the right not to offer individual payment methods for certain events. Tickets are only sold to end customers. The commercial resale of tickets is prohibited. An exchange of tickets is excluded.
§ 4 Entrance
The components of the Geysir Andernach facility may only be entered with a valid admission ticket. Admission tickets entitle the holder to enter the facility for the selected date and time. The admission ticket loses its validity upon entry or when it is cancelled. Admission tickets that have been falsified or manipulated in any other way do not entitle the holder to admission and will be confiscated by the facility without compensation. The same applies in the event of misuse of admission tickets. Geysir.info is entitled to block areas of the facility in whole or in part or to restrict access to them. Such closures or access restrictions shall not give rise to any claims on the part of the visitor. In the event of the loss of an admission ticket, there shall be no entitlement to a replacement ticket or any other compensation. The uniqueness of the print@home ticket is ensured by a printed 1D or 2D barcode, which is checked and validated by a hand-held scanner upon entry to the event. Contracts on this portal can only be concluded in German.
§ 5 Withdrawal of the Organiser
Geysir.info gGmbH is entitled to withdraw from the contract for good cause, in particular if a visit to the geyser is not possible for safety reasons (storm, thunderstorm, flood etc.) or the safety of visitors cannot be guaranteed.
§ 6 Exhibition operation
Individual exhibition areas or exhibits may be shut down for repair or due to other technical problems without prior notice. In the event of failure, partial failure or shutdown of individual exhibition areas or exhibits due to force majeure such as interruption of the power supply, thunderstorms and storm surge as well as due to maintenance and repair work, etc., there shall be no entitlement to a refund or partial refund/reduction of the admission price.
§ 7 Liability and duty of supervision
Visitors to Geysir Andernach are requested to comply with the house rules of Geysir.info gGmbH. These can be viewed at www.geysir-andernach.de or can be sent to you on request.
We expressly point out to all parents, legal guardians and accompanying persons of children and other persons to be supervised to fulfil their duty of supervision carefully, as we cannot release them from this duty. In this context, supervisors, parents and legal guardians are also responsible for all damage caused by the persons to be supervised. In the case of offers for children and pupils, the accompanying persons, independent of the staff of Geysir.info gGmbH, have the duty of supervision.
In all other respects, Geysir.info gGmbH shall only be liable for the proper performance of the agreed service insofar as it or its legal representatives or vicarious agents can be accused of a grossly negligent or intentional breach of duty. The above exclusions and limitations of liability do not apply to damages arising from injury to life, limb or health. In this respect, Geysir.info gGmbH shall be liable without limitation in the event of intent or negligence on the part of its legal representatives or vicarious agents.
§ 8 Right of withdrawal
In principle, there is no entitlement to the return of admission tickets. In the case of services in the field of leisure activities with a fixed time of performance or a fixed performance period, in particular the sale of tickets for cultural and leisure events, there is no right of revocation or return in distance selling transactions pursuant to § 312g II S. 1 No. 9 BGB. Each order is binding upon conclusion of the contract and obliges payment.
§ 9 Data protection
Geysir.info gGmbH processes the personal customer data in compliance with the applicable data protection conditions. The customer allows Geysir.info gGmbH to pass on the personal data to third parties commissioned with the execution of the contract, insofar as this is necessary for the fulfilment of the contract. The company uses external service providers for the billing of purchases made via the online shop.
§ 10 Notice pursuant to the Online Dispute Settlement Regulation
The European Commission provides a platform (ODR platform) for online dispute resolution. You can find this at http://ec.europa.eu/consumers/odr. It is possible to use this ODR platform for the settlement of disputes. Our e-mail address is as follows: info(at)geysir-andernach.de. Furthermore, we are not obliged to participate in a dispute resolution procedure according to § 36 I No.2 or § 37 VSBG. There is no willingness to participate voluntarily. § 11 Final clauses
These GTC shall enter into force on 15.06.2020. The exclusive place of performance and payment is Andernach. The law of the Federal Republic of Germany shall apply. The invalidity of individual sections of these General Terms and Conditions (GTC) shall not result in the invalidity of the entire terms and conditions.
In all other respects, the house and user rules of Geysir Andernach gGmbH apply.
